This End User License Agreement ("Agreement" or "EULA") is between You (the "End-User") and Nazmi Yavuz ("Licensor") for the use of the licensed application (the "Licensed Application") which is made available through the Apple App Store. By downloading, installing, or using the Licensed Application, you agree to comply with and be bound by the terms and conditions set forth in this Agreement.

1. Acknowledgment

The End-User acknowledges that this EULA is concluded between Licensor and the End-User only, and not with Apple, Inc. ("Apple"). Licensor, not Apple, are solely responsible for the Licensed Application and its content. The terms and conditions of this EULA may not conflict with the Apple Media Services Terms and Conditions.

2. Scope of License

The license granted to the End-User for the Licensed Application is limited to a non-transferable, non-exclusive license to use the Licensed Application on any Apple-branded Products that the End-User owns or controls, subject to the Usage Rules outlined in the Apple Media Services Terms and Conditions. The Licensed Application may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.

3. Maintenance and Support

Licensor are solely responsible for providing maintenance and support for the Licensed Application. Apple has no obligation to furnish any maintenance or support services for the application.

4. Warranty

Licensor are solely responsible for any warranties, whether express or implied, that are not disclaimed. In the event that the Licensed Application fails to conform to any applicable warranty, the End-User may notify Apple, who will refund the purchase price of the application. Apple will have no other warranty obligation, and all claims regarding failures to conform to warranty are the sole responsibility of the Developer.

Licensor, not Apple, are responsible for addressing any claims of the End-User or any third party, including:

6. Intellectual Property Rights

In the event of a third-party claim that the Licensed Application or its use infringes on intellectual property rights, Licensor, not Apple, are responsible for handling, defending, and settling such claims.

The End-User represents and warrants that they are not located in any country subject to a U.S. Government embargo or designated as a "terrorist supporting" country. They must also not be listed on any U.S. Government restricted parties list.

9. Third-Party Terms of Agreement

The End-User must comply with any applicable third-party terms of agreement when using the Licensed Application. For example, if using a VoIP application, the End-User must adhere to their wireless data service agreement.

10. Third-Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of this EULA. Upon the End-User's acceptance of the terms and conditions, Apple will have the right to enforce the EULA as a third-party beneficiary.

The Developer reserves the right to discontinue updates to the Licensed Application under conditions of abnormal local or global circumstances, such as political, economic, or health crises.
